Welcome to Carted By You Limited ("Carted By You", "we", "our", or "us"). By requesting a quotation, placing an order, making payment, or using our services, you agree to these Terms & Conditions.

If you do not agree with these Terms, please do not use our services.

1. About Us

Carted By You Limited is a personal shopping and international delivery service that purchases products on behalf of customers and arranges shipment from the United Kingdom to Ghana.

2. Our Services

We assist customers by:

• Purchasing products from approved UK retailers

• Consolidating orders where applicable

• Arranging international shipping

• Coordinating customs clearance where required

• Arranging local delivery within Ghana

Availability of products is subject to the retailer's stock.

3. Quotations

All quotations are based on the information available at the time they are prepared.

Unless otherwise stated, quotations may include:

• Product cost

• Service fee

• International shipping

• UK domestic postage (where applicable)

• Applicable taxes and duties

• Local delivery charges

• Exchange rate used for the quotation

Quotations remain valid for the period stated in the quotation. Prices may change if retailers change their pricing or if exchange rates fluctuate before payment is received.

4. Payment

Orders will only be processed after payment has been received and confirmed.

We reserve the right to decline or cancel any order where payment cannot be verified.

Any bank charges or payment processing fees charged by third parties remain the customer's responsibility unless otherwise agreed.

5. Exchange Rates

Where products are purchased in British Pounds (GBP), quotations are converted using the exchange rate applicable at the time the quotation is prepared.

Actual settlement rates may differ due to payment provider exchange rates and currency movements.

Where applicable, any exchange rate adjustments will be communicated before the purchase is completed.

6. Purchasing Items

We purchase products on behalf of customers using the information provided.

Customers are responsible for ensuring:

• Product links/Images/Screenshots are correct

• Sizes are accurate

• Colours are correct

• Quantities are accurate

• Product specifications are suitable

We are not responsible for customer errors when ordering.

7. Product Availability

Products remain subject to retailer availability.

If an item becomes unavailable after payment:

• we will notify you;

• offer a suitable alternative where possible; or

• arrange a refund for the unavailable item.

8. Shipping & Delivery

Delivery timelines are estimates only.

Shipping times may be affected by:

• airline schedules;

• customs inspections;

• public holidays;

• weather;

• retailer processing times;

• circumstances beyond our reasonable control.

We cannot guarantee delivery by a specific date unless expressly agreed in writing.

9. Customs & Import Charges

Where applicable, customs duties, taxes and regulatory charges form part of the final quotation.

Additional government charges introduced after payment remain the customer's responsibility where legally applicable.

10. Inspection Upon Delivery

Customers should inspect all items immediately upon delivery.

Any issues relating to:

• missing items;

• damaged goods;

• incorrect items; or

• delivery discrepancies

must be reported within 48 hours of delivery.

11. Returns & Refunds

Returns are subject to the policies and approval of the original retailer.

Once products have been purchased on your behalf, orders cannot be cancelled or returned simply because you change your mind, unless the retailer's return policy permits the return.

Refunds may only be available where:

• the retailer accepts the return;

• the goods are defective;

• incorrect goods were purchased due to an error by Carted By You; or

• we are otherwise legally required to provide a refund.

Where a retailer accepts a return, the customer is responsible for all costs associated with returning the item to the retailer, unless otherwise agreed in writing.

However, if the return is required because Carted By You supplied the incorrect item, or the item was damaged while in the care of Carted By You or our shipping partner, Carted By You will arrange or reimburse the reasonable return shipping costs, subject to verification.

Any original shipping, handling, service fees, customs duties, taxes, or local delivery charges paid as part of the original order are non-refundable unless the return results from an error by Carted By You or our shipping partner.

Shipping fees, service fees, payment processing fees, customs duties, taxes, and any other third-party costs incurred in fulfilling your order are generally non-refundable once they have been incurred.

12. Restricted & Prohibited Goods

We reserve the right to refuse any item that:

• is illegal;

• is prohibited under UK or Ghanaian law;

• is dangerous;

• requires special licences;

• breaches airline or customs regulations; or

• presents an unacceptable shipping risk.

13. Limitation of Liability

To the fullest extent permitted by law, Carted By You Ltd shall not be liable for indirect, incidental or consequential losses, including loss of profit, business interruption or loss arising from delays outside our reasonable control.

Where liability exists, our total liability shall not exceed the amount paid by the customer for the affected order unless otherwise required by law.

14. Customer Responsibilities

Customers agree to:

• provide accurate information;

• respond promptly to requests for additional information;

• ensure delivery addresses are correct;

• comply with all applicable laws regarding imported goods.

15. Privacy

We collect and process personal information solely for the purpose of providing our services, communicating with customers, processing payments and complying with legal obligations.

We do not sell customer information to third parties.

16. Intellectual Property

All content on our website, including logos, branding, graphics and written content, remains the property of Carted By You Ltd unless otherwise stated.

17. Force Majeure

We shall not be liable for delays or failure to perform our obligations where caused by events beyond our reasonable control, including natural disasters, pandemics, strikes, government action, customs delays, transportation disruptions or supplier failures.

18. Changes to These Terms

We may update these Terms & Conditions from time to time.

The latest version will always be available on our website and becomes effective immediately upon publication.

19. Governing Law

These Terms & Conditions are governed by the laws of the Republic of Ghana.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Ghana unless otherwise required by applicable law.
